WASHINGTON (Reuters) - Democrats mounted a spirited fight on the Senate floor against John Ashcroft as attorney general on Wednesday, knowing they cannot win but determined to send a message to President George W. Bush.

With both sides conceding Ashcroft will be confirmed by the Senate on Thursday, the big question was how many votes Democrats could muster against Ashcroft, an ardent conservative and hero to the religious right.

A top congressional aide said late Thursday that close to 40 of the chamber's 50 Democrats were expected to oppose Ashcroft. "Right now, we are in the high 30s and have a chance to break 40," the aide said.

All 50 Senate Republicans were expected to vote to confirm.
