Napster to Face Music in Court on Friday

LOS ANGELES (Reuters) - Hundreds of thousands of fans are sending e-mails of support -- and in some cases, flowers -- to Napster as the popular song-swap service prepares for what could be a make-or-break day in court Friday.

But while Hank Barry, Napster's chief executive officer, has received this outpouring of support from users of the popular song-swap service, he has been given the cold shoulder by the big record labels -- which are suing Napster -- ahead of a hearing on an injunction that could shut Napster down.

"I don't want to totally close the door (on a settlement), but I felt like previously we had some good traction to have an agreement and I don't feel that way anymore," said Barry.

He and others at Napster have been busily preparing legal strategies for U.S. District Judge Marilyn Hall Patel's hearing in San Francisco Friday to hammer out the terms of her injunction.
