The Patent and Trademark Office will look at only the two marks and the goods and services offered under those marks and determine whether there is a likelihood of confusion. The PTO will (at least they should not) look at the fame or notoriety of each performer when making their decision.

Personally, I think the names are rather similar and I can see the PTO ruling in Mariah's favor.

Actually an article I read on this last night said something to the effect that because Mary Carey's patent application was for "audio and video recordings" under that name it could cause confusion. Doesn't that apply under that standard? (I'm no lawyer mind you I'm just asking)

Mary Carey actually ran a creditable campaign in the runoff last year for governor of California. She finished in the top 7 or 8 out of 27 candidates. She wanted to run as a Republican but they had no sense of humor.

She's probably for more balanced than Mariah.
